From Aero Precision . . .

Due to the passage of House Bill 1240 by the Washington Legislature and Governor Jay Inslee signing it in to law on 4/25/23, Aero Precision has filed a lawsuit in conjunction with several other plaintiffs to combat this overreaching legislation, seeking temporary and permanent injunction based on the unconstitutionality of this law.

The case was filed on 4/25/23 in the Eastern District of Washington, U.S. District Court. Plaintiffs include Aero Precision LLC , Amanda Banta (2012 Olympian Sport Shooter), Sharp Shooting Indoor Range & Gun Shop, The Range LLC, and the National Shooting Sports Foundation. The complaint is filed against defendants Robert W. Ferguson, Attorney General of Washington State, and John R. Batiste, Chief of the Washington State Patrol.

“We do not agree with this law and we do not think it is constitutional,” said Scott Dover, CEO of Aero Precision. “HB1240 bans some of the most common firearms and parts available. It impacts the lawful ownership of products we manufacture and sell to thousands of our customers in the State of Washington. It also restricts the rights of the individuals, Aero Precision employees, who make these parts. We will fight this law in the courts and are confident in the outcome given the clear rulings in multiple Supreme Court cases, including Heller and Bruen.”

  1. We need to fight back! These Communists (they ARE Communists) have nothing more in mind than enslaving our populace, one firearm at a time!

    • Communists, fascists, corporatists…any authoritarians or anyone who wants to exert power over or otherwise impose their will on others all want the same thing: a defenseless subject or target.

  2. I received the notice sent from a no-reply AP email address. Nonetheless I am glad to see AP joined the fight to return to citizens rights that were stolen…by an agenda rooted in racism and genocide called Gun Control.

  3. The so called “Assault weapons ban” clearly violates the 2nd amendment. WA State Attorney General Bob Ferguson is a attorney, so begs the question: Did he knowingly conspire with other Washington state democrat legislators to intentionally violate Washington citizens 2nd amendment rights and therefore violate the constitution of the United States and the State of Washington. I think he did. The 2nd is clearly defined and simple to understand.

  4. A lot of states are thumbing their noses at the supreme court by passing laws they know will be struck down according to the Bruen decision.
    As soon as these laws are struck down they usually pass similar laws that need to be challenged in the courts and declared unconstitutional.
    It’s a giant game of whack a mole and costs us people of the gun years of time and thousands of dollars in legal fees.

    This process of tying us up and costing us money is the whole point of the exercise

    • You are absolutely correct. It really in my opinion proof of a collapsing republic, I mean if the basis of coequal branches of government is failing it means checks and balances are failing and the whole house of cards cant be long behind. Power is going to be consolidated and tyranny ensue. Further if the “People in charge” are not going to follow the rules of their job then what behooves us from following the rules they make for us? It was a good run, these next decades are going to get rough.

    • Confiscation is in the bill. Current owners are grandfathered. The firearms can be inherited, provided the inheritor can provide proof that the previous owner had the firearms before the law went into effect. The next generation won’t be able inherit them because the first inheritor didn’t own them at the time 1240 became law. I’m sure future generations will take the risk and not comply.

      • The state will make moves on confiscation long before this. I suspect that Bill will be introduced later this year

  5. Impeach on the basis of their violating their oaths of office, where they swore to uphold and defend the Constitution against all enemies, foreign and domestic.

  6. The Supreme Court does not define our fundamental rights by virtue of how people abuse or misuse rights or otherwise violate the law. This is true in the 2nd Amendment context, the First Amendment context and even in federal copyright law. Washington ban and more.

  7. Since these states are using tax payer dollars to enact and enforce unconstitutional laws then using tax payer dollars to defend them, the case plaintiff’s should also have access to tax payer dollars to defend against the unconstitutional laws.

    either that, or all enacting, enforcing, and defending the states unconstitutional laws should come from the personal funds of the governor, the legislators that voted for the unconstitutional law, and the state attorney general.
