We’re fast approaching the one-year anniversary of the murder of U.S. Border Patrol Agent Brian Terry. Since his death, we’ve learned that Agent Terry was shot by a team of Mexican drug thugs using firearms enabled by the ATF operation known as Fast and Furious. The investigation into Terry’s murder has been hampered/stonewalled at every turn, by the ATF, FBI, DHS, DOJ and White House. Amongst other. Last week, the judge in charge of the federal grand jury considering the fate of the one assailant held for the crime—Manuel Osorio-Arellanes—sealed the case. He also sealed the reason why he sealed the case. Thankfully, the washingtontimes.com has seen a copy of the indictment. The Times reveals that Terry’s killing was less of a random encounter and more premeditated murder. And how . . .

Five illegal immigrants armed with at least two AK-47 semi-automatic assault rifles were hunting for U.S. Border Patrol agents near a desert watering hole known as Mesquite Seep just north of the Arizona-Mexico border when a firefight erupted and one U.S. agent was killed, records show.

A now-sealed federal grand jury indictment in the death of Border Patrol agent Brian A. Terry says the Mexican nationals were “patrolling” the rugged desert area of Peck Canyon at about 11:15 p.m. on Dec. 14 with the intent to “intentionally and forcibly assault” Border Patrol agents.

At least two of the Mexicans carried their assault rifles “at the ready position,” one of several details about the attack showing that Mexican smugglers are becoming more aggressive on the U.S. side of the border.

According to the indictment, the Mexicans were “patrolling the area in single-file formation” a dozen miles northwest of the border town of Nogales and — in the darkness of the Arizona night — opened fire on four Border Patrol agents after the agents identified themselves in Spanish as police officers.

The paper also highlights the media-neglected fact that Agent Terry and his fellow officers fired beanbag rounds at the Mexicans at the start of the attack. Shawn P. Moran, vice president of the National Border Patrol Council [above], told the Times that “[CPB] field agents have been ‘strong-armed’ by the agency’s leadership to use nonlethal weapons. He said they were not appropriate for the incident in which Terry was killed.”

Ya think? The entire incident puts paid to DHS Secretary Janet Napolitano’s assertion that the U.S. Border is safe. In fact, yesterday, nuevodia.com.mx reported that U.S. Border Patrol Agents found three bodies of suspected drug traffickers shot execution style in the Tumacacori Mountains north of Nogales, Arizona. Six miles west of Tuscon.

More to the point of this series, Moran joins us in wondering what the hell the ATF was doing enabling gun smugglers in the first place.

Mr. Moran said he understood the “rationale of working things up the food chain,” as suggested in the Fast and Furious probe, but had no idea how ATF planned to arrest cartel members who ultimately purchased the weapons since the agency lacks jurisdiction south of the border and never advised Mexican authorities about the operation.

“It was a ridiculous idea from the beginning, and it baffles us on how it was ever approved,” he said.

And therein lies the tale.

  1. If this is true I can see why the government would want to keep this under wraps. How would they explain to the general public that we are fighting an insurgency along our border with Mexico? If it became public knowledge that are borders were twelve hundred miles of free fire zones then every eligible U.S. Citizen from Oklahoma south would arm themselve (more then we already are).

  2. So let me get this straight…. The BATF is aiding an army of violent foreign invaders in the purchase of weapons to use against the US and its citizens…. Isn’t that terrorism? So our tax dollars are funding terrorists, and our government is allowing a terrorist organization to openly operate without resistance… Anyone else here see a problem with this??!!?! What a messed up world… I’m moving to Canada.

    • The only reason that Canada seems “better” is because its southern border is with the US, not some third world sh!thole. Oh, and also because it’s so f^cking cold up there.

  4. The sealing of the case, sealing of the reason for sealing the case, along with the stonewalling, delays, and blatant lies surrounding this criminal operation will continue to sit poorly with LEOs, the public, or anyone else with a modicum of intelligence.

    Something is terribly wrong here, and it’s hard to imagine that silence is the right approach. The truth will come out and be told, of that I have no doubt. And I do believe heads will roll when it does.

  5. Send the Reserve and National Guard units in various states to the border for training exercises with live ammo.

    • Its a sad day when mexican gang bangers are better shots than the police. How is this even possible? The police get massive subsidies from the government for training, yet the article doesnt say a single mexican was shot, but did say “An undercover sheriff’s deputy, who was driving nearby in another vehicle, was wounded, possibly by friendly fire from officers arriving at the scene.”

  6. i wonder what would have happened if they had run into one of the milita units that helps out boarder patrol, they must know that our boarder patrol agents carry non lethal rounds first. the boarder patrol should be allowed to engage if they themselves are fired upon

  7. the gun trafficking program was designed to actually supply one major drug cartel against another. the other group, though smaller, has been trained by u.s. personnel. this group however, still prefers mexico stay a sovereign nation, and while they will fight to protect their drug routes they are not communistic. they also will not negotiate their rates with american govt. the other group, communist to the core, enemies to the united states, have made a grand bargain with the obama clan. their cut is much reduced with the feds getting a much larger cut. they are also aiding al qeada with the import of both personnel and weapons into united states. if the head of this group gains control in mexico city, one world rule will have been accomplished from colombia to the rio grande, thus setting the stage for the importation of foreign troops via a reliable corridor through mexico. obama knows economy is about to crash and voters will send him packing. good luck on that. obama isn’t going anywhere and the big reason he is in such a hurry to get troops out of middle east is he will soon need them here to put down massive revolt. for proof of this forthcoming operation look no further than preparations taking place in venezuela and cuba. from lengthening of runways to installation of underground bunkers and missile silos, war is being prepared. the border patrol hierarchy is rife with obama agents. false info is fed on a daily basis, leading agents into areas where little activity occurs while huge transport trains are allowed to pass unmolested. most fail to realize that open skies policy in full effect over texas and other border states. among participating air forces being allowed to violate our border are mexico, venezuela, cuba, and russia. indeed, in last cinqo de mayo parade held in mexico city more than 1500 chinese troops participated. not that mexico matters all that much as thousands of foreign troops operate quite openly here in the united states. forget feds actually doing anything about border agents getting killed. they have their orders as well and nothing will be allowed to stop the influx of terrorists and spies into the united states. just in case obama can’t win this next election he is getting ready with martial law program. russian leadership openly talks with their own media bragging on the fact that obama has requested, and will recieve, the use of more than 100,000 russian troops in united states to maintain order. just in case you think our nukes will keep russians at bay, guess who holds ultimaye use on their use, that’s right, the president. codes have already been compromised. they simply won’t be fired on that faithful day. not that we will know anything until it is too late. feds now control the ability to shut down all communications within this country at a moment’s notice. you radio, television, and computers will just go dead.
