The burgeoning Second Amendment sanctuary movement in Virginia seems to have shaken Old Dominion Democrats. So much so, in fact, that they’ve come up with a brilliant scheme to try to blunt its momentum.

From the Virginia Mercury . . .

[T]he proposed ban on particular types of firearms — and the prospect of criminal charges for gun owners who didn’t give them up — seemed to stoke the strongest outrage in the 40-plus rural localities that have declared themselves Second Amendment sanctuaries within the past few weeks. Of the dozens of bills already filed for the session that begins in January, (incoming Senate Majority Leader Dick) Saslaw’s assault weapon bill was the most-read, according to the state’s online legislative system.

Some Democrats had already suggested that the assault weapon bill drawing the most attention may not turn out to be the final product.

Don’t worry, they still plan to enact an “assault weapons” ban and outlaw the sale of scary, especially assaulty looking firearms. But rather than attempting to outlaw possession — i.e. requiring Virginians to destroy/dump/turn in the guns they don’t like — Governor Ralph Northam now says he’s open to grandfathering the guns Virginians already own.

The Northam-backed plan mirrors the federal assault weapon ban passed in 1994, which included a grandfather clause for weapons that were legally owned when the legislation was enacted. The federal ban expired in 2004.

The seven states that have enacted their own assault weapon bans all grandfathered in pre-existing weapons, according to the Giffords Law Center to Prevent Gun Violence.

Northam wants everyone to know that he’s really a big Second Amendment guy at heart.

“I’m a supporter of the Second Amendment. I grew up hunting and fishing,” Northam told reporters Monday morning at an event unrelated to gun policy. “Really what we’re trying to do in Virginia… is we want to make our streets, our communities safer.”

Fudd, thy name is Coonman.

But don’t look for this “compromise” ban to placate gun owners.

In an email to supporters Monday, the Virginia Citizens Defense League, the staunchly pro-gun group fueling the gun sanctuary movement in the state, said Saslaw’s bill was  “a bridge too far” and was likely to be swapped out for something that included a grandfather clause. But the group made clear that it will continue to oppose any assault weapon ban and reject anything presented as a compromise.

“Who are WE to negotiate away the right of future generations to own AR-15s, or their equivalent, and magazines of whatever capacity they want?,” the VCDL email said. “Who are WE to give away the right of future generations to protect themselves from criminals or from a government that’s gone tyrannical, just so we can selfishly have our guns and magazines now?”

More than 40 Virginia counties have announced that they will not comply with new gun control laws by declaring them Second Amendment sanctuaries. If Northam actually thinks that enacting an Assault Weapons Ban Lite gun control bill will change any minds, he’s kidding himself.

“I hear people out there saying that they don’t want law enforcement to enforce unconstitutional laws. Well we’re not going to propose or pass any unconstitutional laws,” Northam said. “So that’s something we should all agree on.”

If he’d contemplate killing full term babies and wearing white robes and blackface in during the 80s do you think it would bother him in the least to make felons of the law abiding Virginia citizenry exercising their 2nd Amendment rights?

  1. And once this blows over a new law actually banning possession will emerge right after the next election. Every day democratic voter take up residence in VA further diluting the Republican base at an alarming rate.

    • The bill I saw introduced DOES include “possession” as part of the language that Dems are trying to enact. The Dems owe Bloomberg for all of the millions of money he put into VA to get them elected. From what I’ve read and heard, Bloomberg is now stating it is time to pay him back by making Virginia one of the strictest gun control states there is.

      • Swinging VA past NJ on Guns would be his crowning achievement and probably the cornerstone of his campaign next year. He’ll promise the same change for the rest of the country.
        Put aside for a minute the Fact gun control has damaged several candidates already the mere suggestion he could have gun bans on the deck for the entire country is a pipedream. The pushback we see in VA would be nothing like the rest of the US.
        And what would happen next would be horrible.
        Besides he’s not nearly as generous as Bernie or Liz with OPM.

  2. SB16 still calls for a total ban, no exceptions. I think this is a ploy to to reduce the attention it gets. I’ll believe in grandfathering when I see the amendment.

    And we should start a pool on what compliance rate they’ll get either. I’ve got dibs on <1%

    • Oh they will grandfather, along with mandatory special registration of any “assault rifles.” Would than make you happier? They have a handful of Democrats in purple state assembly districts who will need an out.

      Point is it is a road that is already mapped out in Virginia
      – UBC
      – Red flag
      – Grandfathered AR ban grandfathered or not depending on what they can get this time around
      – special registration of assault rifles
      – “high capacity” mag ban grandfathered or not depending on what they can get this time around
      – incremental increase in costs/difficulties in CCL

      Those are easily obtainable in the VA state legislature now due to the loss of the state house and state senate. People going on marches now, and celebrating meaningless local “second amendment sanctuary” areas are absolute jackasses if they were not out there working their assess off to prevent what happened in November.

      This is the census year coming up. Virginia will be redistricted by the new Democrat majority in the state house. Then they will be less afraid to put in more draconian measures:
      – Non grandfathered full on AR ban
      – more draconian registration and waiting periods (don’t forget that the Dem politicians in the NE are always saying Virginia is the biggest source of illegal guns)
      – gun licences presentation to buy ammo
      – even stronger red flag from whatever they pass now
      – more restrictions on CCL

      Bloomberg gave more money per capita to Dem politicians in Virginia than any other state. The goal is to make it like NJ. he made support for his gun control the litmus test for his money.

      People saying “Democrats and Republicans are the same” ought to be looking at what we have seen and will see in the Va state legislature. This has already been a 99% partisan alignment fight there, and people who did not work their asses off for the GOP candidates ought the shut the fk up.

      Spot on. The whole thing is a trick. Most people don’t have any proof of when they actually purchased their nasty weapons of war. So the only way to prove they are grandfathered is to register them during some kind of grace period, something that everyone (almost) will do as a way to protect their property.

      And when the list is complete — BOOM — they enact a total ban on purchase and possession.

        America and her Constitution has survived to become the greatest nation in history. France has failed numerous times since then, literally re-writing new constitutions and forming new republics more than a dozen times. And it’s the laughingstock of the world.

  16. How nice of him since Article 1, section 9, clause 3 states that no ex post facto law shall be passed and the 14th Amendment makes it applicable to the states, at least since SCOTUS finally figured out what it meant.
    The feds tried to feed us that” grandfathered” crap in ’94 without telling us they couldn’t take what we already owned no matter how much they wanted to.

    • An ex post facto law punishes people for conduct that was legal when they did it.

      Changing a law to make things illegal in the future that were legal in the past is not an ex post facto law. Almost every law does that.

  17. I have an idea i would like to share here to see if others think it is viable. What would you think about a mass of gun owners gathering up (in a “free” state first), crossing the state border into, say, California or some other state with additional 2A restrictions, and blatantly breaking state laws en masse? Think a few thousand crossing into California, setting up a makeshift shooting range, and publicly breaking the states laws while having so many armed citizens in the area that any attempt by law enforcement to persecute anybody could get very ugly very fast. And once the day is done, everybody would make a mass tactical retreat into “friendly” territory, and disperse from there.

    I think at the very least such an operation could really inspire the pro-2A crowd, that once you hit the “critical mass” of armed citizens, they can not be stopped. It has been over 5 years since the last victory of the people against the government (Bundy Ranch 4-19-14, that should be a day we all celebrate IMO), and while something like what i propose wouldnt have nearly the weight of the Bundy Ranch standoff, it is at least something…

  23. There’s a tired old cliché where I come from, occasionally seen on coffee mugs, bumper stickers, and trucker hats at rural gas stations. It’s one that used to make me smile and chuckle at it’s anachronism. I would not have taken it seriously 20 years ago, but the way things are headed in this country and in Virginia, I’m starting to take seriously the possibility that….the South will rise again.

  30. Oh, you can keep your nasty, icky rifles (but not leave them to your sons, or sell them to a friend) but you have to “register” them first. Registration ALWAYS leads to confiscation. Registration is just the first step in the dream of total citizen disarmament. First, the militarily useful arm, the very militia arms the Second Amendment was written to protect, then the sporting arms,then lastly, the self defense pistols. Resist Virginians!

  31. Every version I have heard about a “grandfather clause” includes mandatory registration with the Socialist Republic of Virginia government. The 1994 assault weapons ban (federal) did NOT include any registration. It simply stopped the manufacture and importation of any new “assault weapons”. Registration ALWAYS precludes confiscation. Always.
