As firearms sales cool off this summer, House Democrats have helpfully given sales of semi-automatic rifle sales a boost by passing H.R. 1808, their latest attempt at banning the most popular long guns sold in America. AR makers may want to send flowers to Speaker Nancy Pelosi who finally managed to twist enough arms in her own party caucus to narrowly pass the bill this evening.
This latest “assault weapons” ban is, of course, nothing more than political theater. Performative legislating meant only to give hapless Democrats something to run on this November.
The bill has zero chance of passage in the Senate where it would require at least 10 Republican votes. And under the Supreme Court’s Bruen decision, banning a rifle that’s owned by tens of millions of Americans clearly violates the Heller decision’s “common use” standard.
Still, Nancy gets to wave to the crowd and claim a win for “gun safety” through the passage of a clearly unconstitutional bill in front of the adoring media before the House breaks for summer recess.

NSSF, the firearm industry trade association, condemns the U.S. House of Representatives’ passage of H.R. 1808, the Assault Weapons Ban of 2022, as amended. The legislation ignores the Constitutional right, upheld by the U.S. Supreme Court, for law-abiding Americans to keep and bear arms that are in common use. NSSF estimates that there are over 24.4 million Modern Sporting Rifles (MSRs) in circulation in America between 1990 and 2020.
“This legislation is as dangerous as it is revealing of the contempt that the House Democrats hold for the Constitution and the U.S. Supreme Court,” said Lawrence G. Keane, NSSF’s Senior Vice President and General Counsel. “Chairman Jerrold Nadler admitted during debate in his committee that he didn’t care the legislation was unconstitutional and defied Supreme Court precedent. Democratic representatives are not fulfilling the interest of ‘the People,’ instead representing special-interest gun control groups that seek to disarm law-abiding citizens and scapegoat them for crimes committed by others.”
The MSR remains the most-popular selling centerfire semiautomatic rifle in the United States today. There are more MSRs in circulation today than there are Ford F-Series trucks on the road. The Supreme Court upheld that commonly-owned firearms are lawful for private ownership in both the Heller and Bruen rulings. Banning of an entire class of semiautomatic firearms can be viewed as nothing short of an outright infringement of Second Amendment rights – rights which belong to the people and not the government. This legislation, however, also includes some semiautomatic shotguns and handguns.
This legislation does nothing to improve public safety, as it doesn’t address criminals acting without regard for law or innocent life. Instead, it will put the lives of those who obey the law at greater risk by denying them an entire class of firearms that are used for home defense.
The previous 1994 Assault Weapons Ban proved to be ineffective at reducing crime. The Centers for Disease Control and Prevention (CDC) concluded the “assault weapons ban” did not result in crime reduction.
The FBI’s Uniform Crime Report shows more murders were committed by individuals using knives, fists and clubs than by those using any rifle – not just MSRs like AR-15s.

I find their need to list “allowed” firearms rather suspicious as well but they wouldn’t purposely kill a market and the ability of companies shut out from rebranding and turning out new products that would be legal now would they.

This bill is DOA, even if a miracle happens and it passes the Senate. Under questioning from NC Rep Dan Bishop, Nader was dumb enough to say on the record that the point of the bill was to ban guns that are in “common use.” Heller specifically protects guns under “common use.” Even without that, the contrafactual comments by Dems and their so-called expert witnesses makes a great argument to defeat the bill on the rational basis test (arm braces are bump stocks, AR-15 bullets liquify the targets, exit wounds are a foot in diameter, there aren’t pictures of school shooting victims because the bodies no longer exist after being shot, etc).
I’m not interested in relying on fickle courts as the only bulwark between the leftist mob and my rights. You’re right, Bruen and Heller are protections… but only when the courts have the right judges. In a few years, who knows?

In regards to the Bruen decision:
The Court made clear that states are still allowed to require a license to carry a firearm in public, and expressly declined to interfere with the public carry regimes of all the remaining states—including those that require firearm training and deny applicants who pose a danger to public safety. The Court’s opinion makes clear that states can continue to require applicants to meet public safety requirements before carrying a gun in public. In addition, the Court affirmed the constitutionality of laws prohibiting guns in “sensitive places” such as schools, government buildings, polling places, and courthouses.
Besides the former and present New York concealed carry law , five other states have similar requirements: California, Hawaii, Maryland, Massachusetts, and New Jersey. These states have some of the lowest rates of gun violence in the country.
In regards to the Heller decision:
Ever since the day Heller was passed the courts have pretty much ignored it and to prove this an avalanche of anti-gun laws were passed and went into law.

Not exactly like that. The most common knife used in knife attacks in the United States are common kitchen (e.g. ‘chefs’ type knives) and ‘dinner’ knives (e.g. steak knives) … (what we call generally overall ‘cutlery’).
According to the U.K. House of Commons in 2001 there were “41,000 (selected) offences involving a knife or sharp instrument in England and Wales (excluding Greater Manchester Police Force)” (for Albert since he does not know how to do actual research > https://commonslibrary.parliament.uk/research-briefings/sn04304/)
The use of the “selected” here for the UK is interesting because that’s how the UK does its crime stats – it uses a ‘selection’ process that picks ‘selectively’ from those which are recorded by police but does not use all crimes that were reported. This is the UK parallel of the U.S. system where crimes make it into stats only, basically, if the perpetrator was identified AND arrested AND (most times) convicted. Both of these systems, the UK and the US exclude 89% of the reported crime from the stats because of this. In over 90% of criminal violent knife crime in the U.S. and the U.K. the perpetrators are never identified AND arrested thus no convictions – these never make it into stats despite the crime being reported. And despite the U.K. ban on those knives you reference the most common knife used in knife attacks in the U.K. is also common kitchen (e.g. ‘chefs’ type knives) and ‘dinner’ knives (e.g. steak knives) … (what we call generally overall ‘cutlery’). The U.K. is full of criminal knife crime the citizens never see reflected in stats.
But on the subject of knives, a small example using the U.K. the U.K. banned importing, selling, renting Samurai Swords: Overall british criminals who did not use a Samurai Sword added a shorter, cheaply and easily made, widely available version that’s not a real Samurai Sword (sort of ‘Saturday night special’ version) to their arsenal and started using those. Real ‘Samurai Sword’ related violent crime went down sort of because a newer generation of criminals went with the ‘Saturday night special’ version and ‘Saturday night special’ version crime went up. Then when this got noticed, this newer generation of criminals started switching to mostly knives that were easily available (cutlery) about everywhere and anyone could buy (or purloin in some manner and no one would care mostly) and today the U.K. is basically awash in violent criminals carrying cutlery and committing violent crimes with them and around 90% of its not even reported in stats today. So in effect the ‘Samurai Sword’ related violent crime increased after the ban on ‘Samurai Swords’, the ‘Samurai Swords’ just became what was available in cutlery. The U.K. government response – “oh look, we have a knife ban” … for the least likely knives to be used in U.K. violent knife crime today.
When the AWB becomes law.

I’m having a hard time reconciling your opinion with your oath. First, we are citizens. The term civilian refers to those not in the military. But, we are all citizens. Second, as such, we have the God given right to own weapons that can defend the Constitution, the physical security of our country and our nation. Last, if any of the above escapes you I suggest you read the Constitution, the Bill of Rights and the Federalist Papers. Oh, and you might want to glance at that oath again.

Strange post for anyone claiming to be a solid believer and supporter of the US Constitution. The 2nd Amendment was not written for only the serving military or veterans. It was written for everybody. That includes the arms we the people are assured the right to keep and bear.
I own two firearms that HR1808 specifically bans by name, not just generic description. I know the Senate will not pass a Bill like it, that’s not the point. My guns are not hurting anyone. I should not be punished for the bad deeds of anyone who is not me.
