House Judiciary Committee Republicans sent a letter to ATF Acting Director Marvin Richardson over the agency’s proposed rule change on “ghost guns.” The ATF is currently seeking to reclassify AR uppers and receivers as fully functional firearms, an attempt to prohibit Americans from producing homemade firearms.

According to the letter, the ATF’s latest proposed rule change “is deeply flawed, beyond the scope of ATF’s authority, contrary to years of previous ATF opinions, and harmful to millions of lawabiding American firearm owners.”

What’s most concerning to the members of Congress is the agency’s desire to circumvent Congressional legislation surrounding firearms and gun control, which they explicitly spell out:

ATF concedes that its “new definition would more broadly define the term ‘frame or receiver’ than the current definition.”4 Moreover, ATF expands the definition of a firearm beyond the intent of Congress in the proposed rule. The ATF includes “a weapon parts kit that is designed to or may readily be assembled, completed, converted, or restored.” However, the GCA defines a firearm as:

A) any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive; (B) the frame or receiver of any such weapon…

When passing the GCA, Congress did not include “weapon parts kit[s]” and the ATF took it upon itself to include assembled and completed where Congress explicitly left those actions out of the governing statute. In fact, ATF seeks to unilaterally insert a new definition using language from the Federal Firearms Act (FFA) of 1938 which Congress affirmatively repealed in the Gun Control Act of 1968 (GCA). ATF attempts to resurrect the FFA’s language through its new regulatory definition of “the frame or receiver” so that a single weapon might be comprised of multiple “frames” and “receivers.” Any of these “parts” in ATF’s interpretation would be considered a firearm so long as the Director decreed any “specific part or parts of a weapon is the frame or receiver.” By doing so, ATF disregards its controlling statutory language in the GCA and ignores Congress’s clear legislative intent in repealing the FFA.

The Biden administration has taken aim at ghost guns because they have absolutely no idea how these firearms are built (it only takes half an hour!) or the process for obtaining various parts kits. What’s amazing is the very people “proposing” these rules have never purchased lowers or upper kits in their lives. They fail to realize the shortfalls their regulatory action will have.

These gun control advocates truly believe they’re doing something right by saying every single part in a parts kit needs to be serialized and undergo a background check. But what this proposal really does is create a de facto registry.

If you have a home made firearm — or even a factory firearm —  that you built at home and eventually need to replace the trigger or the stock, under this rule change, you would have to undergo a background check at an FFL. Implement this over a period of time and eventually, the government can piece together what types of firearms every individual has and a rough estimate of how many guns a person owns.

This sets a very dangerous precedent, especially with gun control zealots hellbent on confiscation.

“Leaders” at the ATF are using the regulatory agency to implement this because there isn’t enough support in Congress to make these changes through the legislative process. That should tell Beltway insiders something: most Americans love and respect the Second Amendment. We want the ability to defend ourselves and our families. We want to have the ability to hunt and partake in the shooting sports. It’s why we elect those who fight for the right to keep and bear arms. And it’s why David Chipman’s confirmation as head of the ATF will ultimately fail.

Cracking open a history book, one finds that in every case, when a tyrant or oligarchy takes power, they play within the rules for a time, then slowly begin ignoring the rules, then very quickly replace the rules with their own system (and call it progress). We’re pretty close to the last one.

    We can dance around “well, uh, they can’t do that!” all we want, but when there’s some manufactured event, martial law is declared, and the U.S. government allows the U.N. to send troops to augment those already here that are eager to defy the Constitution…are you going to scream about how that’s illegal?

          The sequence of events I was talking about before includes people coordinating plans to react if the govt begins to fail or lose control. People will see it coming, they will not let it roll over them.

          A lot of things would happen, the beginning of a complete financial collapse will be the biggest impetus for people to act. Martial Law would be a huge step that would drive the market downwards. People will panic. All that will be left then is for them to pick sides.

        • I retired from the military 21 years ago and worked as a contractor with the military until I retired last year. All of the people I worked with in the past 20 years, at Strategic Command (NUKES), NSA and other organizations are pretty much like the men no women I served with and aren’t out to get you with nukes or anything else.

    As a matter of fact gun dealers who go out of business are not required to even turn in their records if they are 20 years or more old.

    As far as registry for guns it’s not needed as any weapon that was prohibited would become totally useless to the owner. The owner could not own it, sell it, trade it, take it to a public range or use it in a self defense situation because being caught with a prohibited weapon would entail prison time, a huge fine, loss of one’s job and prohibition from owning firearms’ for life. The new registry law if ever passed could allow a grandfather cause as was done with machine guns and they would be subject to NFA rules. No newly manufactured weapons would be permitted to be sold.

    Yes, ghost guns are increasing being used in shootings across the country.

    In July 2020, an individual who was prohibited from possessing guns allegedly murdered two people in Pennsylvania using a homemade 9mm handgun.9

    In November 2019, a 16-year-old shot five of his classmates at Saugus High School in California—two of them fatally—using a homemade handgun, before fatally shooting himself.10

    In August 2019, a shooter used a homemade gun kit to build a .223-caliber firearm that he later used to fire 41 shots in 32 seconds in a bar in Dayton, Ohio, shooting 26 people and killing nine.11

    In 2017, in Northern California, a man prohibited from possessing firearms ordered kits to build AR-15-style rifles. On November 13, he initiated a series of shootings that began with fatally shooting his wife at home, followed by a rampage the next day during which he fired at multiple people in several different locations, including an elementary school, killing five people and injuring dozens more.12

    In 2013, a shooter opened fire in Santa Monica, California, shooting 100 rounds, killing five people, and injuring several others at a community college using a homemade AR-15 rifle. Reporting indicates the shooter had previously tried to purchase a firearm from a licensed gun dealer and failed a background check, potentially indicating why he opted to order parts to build a gun instead.13

    Law enforcement officials around the country are sounding the alarm about the dramatic increase in the recovery of ghost guns at crime scenes in their communities. ATF reported that approximately 10,000 ghost guns were recovered across the country in 2019.14 Ghost guns have also been illegally trafficked to Mexico.15 In addition:

    In 2019, Washington, D.C., police recovered 115 ghost guns, a 360 percent increase from 2018, when they recovered 25 ghost guns, and a 3,733 percent increase from 2017, when only three such firearms were recovered.16

    In 2019, ATF reported recovering 117 ghost guns in Maryland with almost 25 percent recovered from Baltimore alone. Ghost gun recoveries in the state then tripled in 2020.17
    According to law enforcement in Philadelphia, ghost gun recoveries in that city rose 152 percent from 2019 to 2020.18

    The special agent in charge of the ATF Los Angeles Field Division reported in January 2021 that 41 percent of the division’s cases involve ghost guns, and a May 2019 statewide analysis in California found that 30 percent of all guns recovered in connection with a crime in the state did not have serial numbers.19

    In addition, an investigation by The Trace found that ghost guns are increasingly becoming the weapon of choice for violent white supremacists and anti-government extremists.20

    In conclusion the ATF is a law unto itself and as in the past it rules at 8:00 AM and it is then a new “regulation” (disingenuous term for new law) is now the law of the land at 5:00 PM.

    No Judge Conservative or Liberal will declare the ATF ruling illegal or Unconstitutional because ghost guns are a danger to the people of the country and even the much ballyhooed Scalia decision with the usual double talk and smoke and mirrors declared “The Courts had the right to regulate firearms” (slick disingenuous term for ban or restrict firearms).

    In conclusion your right to own a weapon rests with the rulings of the courts, not the Constitution, and history has proven this reality like it or not.

    No sane person would want ghost guns legal and no other civilized nation tolerates them.

      Tobacco use deaths are sanctioned by the U.S. government because they do nothing to remove tobacco products knowing they essentially murder over 400,000 people in the U.S. every year. Tobacco products are the only product on the market where the manufacturer freely admits (today, didn’t used to in past) their product is intentionally designed to cause addiction and facilitate or cause death in thousands every day – and the government does nothing to stop sales of the product in the U.S. Tobacco use is not a right, but let one person exercise their right by building a gun and the government is ready to send in armed forces to confiscate guns and remove rights because someone did something bad with a gun.

    Amendment XX, Section 4 of the United States Constitution:

    The Congress may by law provide for the case of the death of any of the persons from whom the House of Representatives may choose a President whenever the right of choice shall have devolved upon them, and for the case of the death of any of the persons from whom the Senate may choose a Vice President whenever the right of choice shall have devolved upon them.

    Since there is no enumerated federal power to regulate firearms, one could argue that the feds technically have no authority (other than the self-imposed authority to shoot your dogs and then each other through the wall).

    The fact that we have a 2nd Amendment even strengthens the argument that they (the ATF) is an autocratic, unchecked, rogue arm of the Federal Government and nobody has even batted an eye at their spurious existence and capricious antics.

    • I remember 2005, I still lived in Virginia at the time but have moved since. The ATF had a “pilot program” they wanted to enact nationwide. The ATF put agents outside gun shows in Virginia from May 2004 to August 2005 as part of that “pilot program”. These agents, in a hostile manner, blocked, accosted, questioned, harassed, and threatened show attendees and tried to discourage them from purchasing guns. And before purchase show attendees were interrogated and accused of being firearms dealers without a license and detained in police vehicles, and gun buyers’ homes were visited by ATF and police. They had accosted me, I told them to leave me alone and went past them. They followed me home after a purchase and leaving the show – they pulled up outside and came to the door with the police, knocked, I opened the door, and the ATF demanded to see the gun I had purchased at the show. I asked to see the search warrant. They said they did not have a warrant and did not need one. I told them as soon as they showed me a search warrant I would show them the gun peacefully, but if they tried to enter without a search warrant they would see it from the end of the barrel. Told them to leave and shut the door and locked it.

      I peeked out a window and see a lot of radio use going on. Then there was some raised, angry voices, the ATF was in an argument with the police. The ATF left a few minutes after the police left.

      Politicians will continue this behavior because they are never held accountable that’s the sad truth of it all. Covid and not the “vaccine” seem to be the perfect test to see how you will comply.

          there’s this great scene in the movie “dr. zhivago” where the cossacks that have been fighting for the reds and have won are now expecting a reward for their services, and the partyman is explaining to them, “No you don’t understand, as the military struggle recedes the political struggle intensifies!” and the cossacks all shift uncomfortably as they suddenly realize that they’re about to be discarded and excluded ….

  11. Whether they should regulate “ghost guns” is irrelevant. They have NO way to prevent people from making their own guns.

    You can sand cast a receiver with some scrap aluminum, a clay crucible, a bag of sand, and some scrap pieces of 2×4 (or similar square frame to pack sand into.

    Then you just hog it out with a drill press and check the dims with a caliper and a pin gauge set. If you know how to make sand cores, you can even save yourself a lot of machining work.

  12. BATFE aka ATF, is an ENFORCEMENT agency, not a REGULATORY agency. As I have said before, you can be one or the other, but you CANNOT be both. If they have the ability to do both, that is akin to police being able to make laws/statutes on a whim. However the government seems to give BATFE the power to do both; which is all the more reason BATFE/ATF needs to be abolished.
