“I have emergency powers,” Grisham told The New York Times. “Gun violence is an epidemic. Therefore, it’s an emergency.” During the press conference, she also indicated that she probably would extend the order, which she said would be lifted only if “the epidemic” of gun violence ended after 30 days, adding, “I bet it’s not over in 30 days.”

Historically, George Mason law professor Robert Leider told the Times, orders like this one have been issued “when you have public disorders or other states of emergency, but most states of emergency usually involve something more acute.” Leider was skeptical that the ban would be upheld in court, saying, “I’m not aware of any precedent for this just for general criminal wrongdoing.”

State Reps. Stefani Lord (R–Sandia Park) and John Block (R–Alamogordo) on Saturday said Grisham’s order was grounds for impeachment. “This emergency order violates the Governor’s oath to protect and defend the rights of New Mexicans,” they said in a press release. “The legislature has a duty to intervene when the government is overstepping its boundaries, and Governor Grisham’s order and comments disqualify her from continuing her tenure as Governor.” Lord called the order “an abhorrent attempt at imposing a radical, progressive agenda on an unwilling populace.”

    Yes, yes, I know…it’s a Fox News link. I checked the site this morning for kicks, and saw the story, so I read it. Glad I did. Rep Ted Lieu (D) actually stated that a Governor cannot violate the Federal Constitution, which is certainly true, but then it raises eyebrows to Spock “that’s illogical!” levels considering it’s coming from a member of the Party that has been stomping on the USC and 2A for years now.

    I hope Lieu’s comment comes around to bite Newsom on the kiester the next time the Dems here try to pass their next spate of gun control.

      • I’ve watched Fox decline from a trusted news source several years ago to just another mouthpiece today. I sometimes look at the site for general news articles, but I’ve lost all respect for pretty much everyone there (except Carlson, but they booted him). Sean Hannity, Bill O’Reilly, Nancy Grace, Gutfeld, etc…they started out as relatively reliable conservative pundits many years ago, but nearly everyone (even the venerable Rush Limbaugh, whom I began following as early as 1992) leaves their conservative roots behind and becomes “mainstream” once they reach a level of popularity that shifts their allegiance from a moral compass to their advertisers.

        So, yeah…a bit of an apology for pointing people here to Fox News. I don’t support that institution so much anymore.

        • Limbaugh was great opposition when the Clintons were in power. But when the Republicans came back and then completely failed to change anything he simply would carry water for those RINOs and NeoCons who kept expanding the Federal Government just as much as the big-state liberals did.

  3. On the flip side, I have seen some of the damage that greedy lawbreakers and psychopathic hate-filled people have wrought on the weak and unprotected. As a Christian, I am a bit embarrassed to admit that I see neither remorse in their actions, nor redemption in their futures.
    I also would argue that they have effectively “Voted themselves OFF of the Island”.
    Their allowance to remain free to damage our society and even their right to life has been put into question.
    And this by their own selfish and seemingly endless predatory need to damage others.
    In other words “Enough is enough”.
    It comes to a point where their actions MUST be stopped.
    It is necessary for the health of society to expel them.

    Law abiding citizens have every right to not obey this very unconstitutional act of tyranny by Grisham. The order is not law, nor can the governor create law by executive order, nor is it permitted by NM state or federal law that the governor can ‘suspend’ or do away with U.S. constitutional rights, under a ‘public health emergency’ order.

    The writ of habeas corpus, as specified in Article I, section 9, of the U.S. Constitution is the only provision of the Constitution which may be suspended and even then, only in “cases of rebellion or invasion.”

    There is no ‘public health emergency’ exemption to the U.S. Constitution or the NM constitution or in federal or NM state law, or in ‘analogous’ law at the founding or before or even after, that allows a state governor to suspend constitutional rights by issuing an order under ‘public health emergency’, heck, even the POTUS can’t do that.

    • Right or wrong, there is law for this in NM.

      NM Stat § 12-10-17 (2021)

      “Upon request of the mayor of a municipality or the sheriff of a county or a majority of the members of the governing body of the municipality or county having jurisdiction and after finding that a public disorder, disaster or emergency which affects life or property exists in the state, the governor may proclaim a state of emergency in the area affected. The proclamation becomes effective immediately upon its signing by the governor, but the governor shall give public notice of its contents through the public press and other news media.”

      NM Stat § 12-10-18 (2021)

      “A. During the existence of a state of emergency, the governor may, by proclamation, prohibit:

      (1) any person being on the public streets, in the public parks or at any other public place during the hours proclaimed by the governor to be a period of curfew;

      (2) any designated number of persons from assembling or gathering on the public streets, public parks or other open areas, either public or private, or in any public building;

      (3) the manufacture, transfer, use, possession or transportation of any device or object designed to explode or produce uncontained combustion;

      (4) the transportation, possession or use of combustible, flammable or explosive materials in a glass or uncapped container of any kind except in connection with the normal operation of motor vehicles, normal home use or legitimate commercial use;

      (5) the possession of firearms or any other deadly weapon by a person in any place other than his place of residence or business, except for peace officers;

      (6) the sale, purchase or dispensing of alcoholic beverages or other commodities or goods designated by the governor;

      (7) the use of certain streets or highways by the public; and

      (8) other activities the governor reasonably believes should be prohibited to help maintain life, property or the public peace.

      B. Any proclamation issued under this section becomes effective immediately upon its signing by the governor, but the governor shall give public notice of its contents through the public press and other news media. The restrictions may be imposed during times, upon conditions, with exceptions and in areas of the state designated by proclamation of the governor from time to time.”

      From the standpoint of the legislation itself, the only open questions are whether “gun violence” rises to the level of public disorder, and whether there was a request by any local officials. I found no definition of “public disorder.” Whether this law violates the U.S. Constitution is a different question. There federal laws which grant the President similar emergency powers, on a nationwide scale.

      They are testing the waters.

  5. Are you sure she’s not from New Jersey? She sounds like a New Jersey politician. I’m terrified that our Govenor Phil Murphy will follow her example (just like he follows the bad examples of New York and Commiefornia when it comes to gun-control laws).

    I replied to Governor Gun-Grabber Grisham on Twitter with the following two tweets:

    1) That’s not the way rights work.
    Next you’ll claim you “have jurisdiction over” libel laws, so you can shut down newspapers that criticize you, arrest reporters who criticize you, ban books you don’t like, shut down churches, synagogues, and mosques whose ministers criticize you.

    2) You told the NY Times, “I have emergency powers. Gun violence is an epidemic. Therefore, it’s an emergency.”
    Imagine if you’d said, “I have emergency powers. Islamic terrorism is an epidemic. Therefore, it’s an emergency. I’m shutting down mosques and rounding up all Muslims.”

The Dems and Commies (but I repeat myself) are all worked up over an unarmed “insurrection” on Jan. 6, but Grisham has performed an actual insurrection – placing law enforcement personnel on a track to overthrow a substantial part of the USConstitution. Not only should she be prosecuted for federal and state civil rights violations, but she should also be prosecuted by the Feds for insurrection.

    • The only authority Grisham has over laws in New Mexico is to either veto or not, or sign into law, laws passed by the state legislature and she has authority to enforce the law enacted by the legislature. She does not have the authority over the law she claims she does, and she certainly does not have an ’emergency’ power to suspend constitutional rights under a ‘public health emergency’ (no state governor does), yet another example of her tyranny – usurping the power of the state legislature.

    When a hate-filled male fantasizes about cutting off a female’s breasts, he is, and should be, immediately arrested and institutionalized.
    If he carries out his mentally corrupt “need to make a difference” it is society’s duty to find, arrest and punish him. Quickly!
    When a hate/filled female has been brainwashed into believing that “all guns are penises” she is on the same plane as the male.
    Cutting OFF the male’s right to possess a firearm is symbolically cutting off his penis.
    When does this psychotic behavior beg the attention of psychiatrists to proclaim the psychosis and law enforcement to arrest and institutionalize the psychotic? The motive is the same in either case. Hate.

  19. So if the governor committed murder on video, who would have the power to arrest her? Same for an order prohibiting some citizens from voting or suspending an election so she could stay in power?

    Seems to me that any Sheriff or other law enforcement agency in the state could arrest her for “Deprivation Of Rights Under Color Of Law” which although a Federal Crime, it could be argued that the Federal Government is ignoring the enforcement of this law, for purely political reasons and a Law Enforcement Agency could ask a federal judge to allow them to prosecute in federal court.

    Depending on the outcome of the enforcement, penalties range from not less than 1 year in prison to life in prison.

    Fingers crossed that someone does the right thing here. Otherwise, anyone impacted can seek redress in Federal Civil Court for any illegal infringements. New Mexico has a similar Civil remedy, but it holds the state and it’s subdivision civilly liable, not the individual committing the act.

    The Governor is 100% guilty based on her actions and public statements and so would any law enforcement officer enforcing her dictate.

    Shouldn’t trampling the Constitution (Under color of authority) because you hate gun owners be punishable as a HATE CRIME?
    And if Vigilanteism has been “approved” as a God-Given Right to “Friends Of The DOJ”, then it becomes a protected right for all.
    The only non-peaceful person to get out of hand on 6JAN was a cop so scared of a girl that he whipped it out and shot her. I am not aware of any drug use study of him, psychiatric workup, disciplinary hearings or demotions, has anybody else?
    All these behaviors have been given the official approval of the Department Of Justice. Their tacit acceptance of crimes against “The People” speak for our official, crooked, demented government.
