Both cases are now facing continuing challenges in the Ninth Circuit Court of Appeals.

Duncan was heard last Tuesday in front of an en banc panel of 11 judges, most of whom are not politically aligned with the Second Amendment. It is expected that the en banc panel will overturn the two previous Duncan victories, leaving it to the SCOTUS to finally decide the matter – if it takes on the case.

In parallel, the Ninth Circuit has upheld the stay in Miller and blocked it from proceeding altogether until Duncan and another 2A case are fully decided. This means both the “high capacity” magazine ban and the “assault weapon” ban remain in full effect as defined by the law, but that is not stopping Kali Key, SDCGO, and FPC from continuing the fight to the Supreme Court.
