John Saul owns and lives in the curiously named New York Store Western Outfitters in Walla Walla, Washington. That’s how he came to confront a known gang member who broke into the store—no doubt craving a bialy and a schmeer—at 2:30 Friday morning. They got into a fight with Saul firing a number of shots at Caspar Chavira, Jr., hitting him at least three times. But there’s some question as to where the whole thing went down . . .

Police found the burglar outside with bullet wounds on his calf, torso and head.  They have not said whether the shooting was inside or outside the store.  Although, they have confirmed that five shell casings were found outside of the store.

Chavira was taken to Saint Mary’s Medical Center where he died around 3:30am Friday.

No word as to whose casings those were outside. And just because some shots were fired outside the store doesn’t necessarily mean Saul continued to fire after the threat was over (the po-po are still piecing the whole magilla together).

Saul, though, is no idiot. Despite being approached by a kndo.com TV reporterette, he’s exercising his right to STFU about what happened. And Chavira certainly won’t be available to shed any light on the situation.

    I smell a TDA semi auto.Good shooting on the part of the store owner, nonetheless.

  2. I travel to ‘Wally World’ every month, and it’s an *extremely* gun-friendly town. With a large population of gang-bangers and ‘camp followers’ (relatives and associates of the felons locked up in the Washington State Penitentiary), residents have good reason to be familiar with defensive firearms use.

    In this part of the country, when the shooting takes place in your home or your business, you’re simply *not* going to be charged unless it’s obviously a bad shoot like a love triangle or a drug deal gone bad.

  3. This case will probably illustrate a point that’s been seen in many other self-defense with a firearm situations:

    Without a complainant there likely won’t be charges filed. (And if there are charges filed they will be much easier to beat.)

    Some folks might not want to say it, but if you’re going to draw your gun and use it you might as well destroy the person/thing you’re using it against. I’d much rather live with a lifetime of “guilt” from an encounter than spend years of my life behind bars for trying to be humane in my approach to self-defense.
